Eligibility Requirements for Statutory Supervisors
Part 10.7A of the Work Health and Safety (Mines) Regulations 2022 outlines the necessary positions related to mines. Mine operators appoint statutory supervisors to perform essential functions for mine operations.
To be appointed as a statutory supervisor at a mine, they must:
- Have 2+ years’ relevant experience.
- Complete an approved WHS risk management unit.
- Pass the required legislation examination for statutory supervisors.
Statutory positions vary in categories, each with distinct functions, obligations, and required qualifications. Some roles require statutory certificates.
Statutory Positions
According to WHS law, mine operators must appoint qualified individuals to the statutory positions listed in Schedule 26 of the WHS Mines Regulations. Here are five key statutory positions:
- Site Senior Executive
- Exploration Manager
- Underground Manager (Non-Coal)
- Underground Manager (Coal)
- Quarry Manager

Statutory Supervisor Responsibilities
A statutory supervisor at a mine is responsible for:
- Assigning tasks to workers in their designated areas.
- Overseeing and managing workers and others on-site.
- Inspecting travel routes and work areas for potential risks or hazards.
- Ensuring, as far as reasonably possible, that workers and others are safe from hazards.
- Providing written reports to the next supervisor during a handover, as required by regulation 630.
Transition from Section 44
to Schedule 26
Schedule 26 has replaced Section 44, which previously outlined the requirements under the Mines Safety and Inspection Act 1994. This change is part of the updates introduced by the Work Health and Safety (Mines) Regulations 2022.
Under transitional arrangements for the WHS Mines Regulations, a competent person can serve as a statutory supervisor until March 20, 2026. After this date, individuals must meet eligibility criteria for their respective statutory positions.

You must complete the risk management Units of Competency recommended by the Department of Energy, Mines, Industry Regulation and Safety (DEMIRS). These units represent the minimum standard for statutory positions.
